§1 General provisions
These Terms and Conditions set out the rules for using the online store available at https://nimesboutique.pl and the rules for concluding distance sales contracts.
The Seller is Nikola Mejer, selling as an unregistered business activity within the meaning of Article 5 of the Polish Entrepreneurs Law, correspondence and return address: ul. Gdańskiego Kolejarza 55, 80-716 Gdańsk, Poland, email: kontakt@nimesboutique.pl.
The Buyer may be a natural person, a legal person or an organisational unit with legal capacity. Provisions concerning consumers also apply to an entrepreneur with consumer rights where required by applicable law.
Browsing the store assortment does not require an account. Placing an order may also be possible without registration if the store provides such functionality.
§2 Technical requirements
To use the store, the following are required:
- a device with internet access,
- an up to date web browser,
- an active email address,
- enabled cookies and JavaScript.
§3 Products and prices
The subject of sale are products presented in the online store.
Product prices are shown in Polish zloty and constitute the total price of the product. Delivery costs are presented separately in the cart and during checkout.
In the event of a price reduction, the promotional price is presented together with the lowest price of a given product from the 30 days before the reduction was introduced, in accordance with applicable law.
§4 Placing orders
- The Buyer adds the selected product to the cart.
- The Buyer chooses the delivery and payment method.
- The Buyer provides the data necessary to process the order and contact the Buyer about the order.
- The Buyer confirms the order by using the button finalising the purchase.
Placing an order means an offer to conclude a sales contract. The contract is concluded when the Seller confirms acceptance of the order for processing.
The Seller may contact the Buyer to confirm data or clarify doubts related to the order.
If execution of the order becomes impossible, the Seller will immediately inform the Buyer and refund payments received to the extent the order cannot be fulfilled.
§5 Payments and sales documents
Available payment methods are presented in the cart and on the payment methods page.
At the request of the customer, the Seller issues a sales document in accordance with applicable law.
§6 Delivery
Delivery is carried out within the territory indicated in the current store offer. The expected delivery time and delivery cost are shown when choosing the delivery method and on the relevant information page.
The maximum delivery time is 30 days unless a shorter period is specified in the product description or during checkout.
§7 Withdrawal from the contract
A consumer may withdraw from a distance contract within 14 days from the date of receiving the goods, without giving any reason.
To meet the deadline, it is enough to send the statement before it expires to kontakt@nimesboutique.pl or to the correspondence address of the Seller.
The Buyer is obliged to send back the goods without undue delay and no later than within 14 days from the date of withdrawal from the contract.
The Seller refunds all payments received from the Buyer, including the cost of the cheapest ordinary delivery method offered by the store, no later than within 14 days from the date of receiving the statement of withdrawal. The Seller may withhold the refund until the goods are received back or proof of return is supplied.
The direct cost of returning the goods is borne by the Buyer unless the Seller has informed otherwise.
The right of withdrawal does not apply in cases provided for by law, in particular for goods made to the Buyer specification or delivered in sealed packaging which cannot be returned after opening for health protection or hygiene reasons.
§8 Complaints
The Seller is liable for any lack of conformity of the goods with the contract in accordance with applicable consumer law.
A complaint may be submitted by email to kontakt@nimesboutique.pl or in writing to the Seller address. It is recommended to provide the order number, describe the issue and indicate the preferred way of handling the complaint.
The Seller replies to a complaint within 14 days from the date of receipt.
§9 Reviews and user content
Published product reviews may come only from customers who purchased the product or are verified by the Seller in another reasonable manner.
The Buyer may not provide unlawful content.
§10 Personal data and final provisions
Rules of personal data processing are described in the Privacy Policy available on the store website.
In matters not regulated by these Terms and Conditions, the provisions of Polish law apply, in particular the Civil Code and the Consumer Rights Act.
